Terms & Conditions
By booking or participating in any program, event, training, or service offered by Suzi Jayne ("the Company"), you agree to the following Terms and Conditions. These apply to all in-person programs, online programs, blended offerings (in-person and online), custom training and mentoring, and 1:1 personal sessions.

These Terms and Conditions are made up of two sections: (1) Participant Agreements, which include section A for in-person, blended, and custom offerings, and section B for online programs; and (2) the Risk Warning & Waiver of Liability, which must be read and acknowledged separately.

By proceeding with a booking, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you are booking on behalf of other participants (e.g. family members), you confirm that they have also read and agreed to these Terms and Conditions in full. The Company may require each adult participant to provide individual written or digital acknowledgement prior to attending any program, and reserves the right to deny participation if this has not been completed.
1. Participant Agreements:
A) In-person & Blended Programs, Custom Training & Mentoring, and 1:1 Personal Sessions
Program/Experience Details
All program descriptions are provided in good faith and are designed to reflect the nature and scope of the offering. The Company reserves the right to adapt or modify details to best meet participant needs and program intentions.
Registration & Confirmation
Your place in any program is confirmed upon receipt of full payment and submission of any required documentation, including but not limited to the Risk Waiver (for in-person programs).

Itinerary/Program Subject to Modification
All schedules and session plans are subject to change due to group needs, facilitator discretion, weather, or other unforeseen circumstances. Changes will be communicated where possible.
​
Accommodation & Meals (if applicable)
Where accommodation or meals are included, details will be provided in advance. Special dietary needs can be accommodated within reason and must be communicated at the time of registration.

Payment of Fees and Charges
Full payment is required upon booking unless otherwise stated. For programs that offer payment plans or staged payments, all amounts must be received by the stated due dates. Late payments may incur a fee of $15 per reminder notice issued. Continued failure to make payment may result in forfeiture of your place in the program, with no entitlement to a refund or credit.

Family Ticket Definition for The Village
A Family Ticket grants access to one immediate family unit. This includes up to two adults and their dependent children. This ticket does not extend to multiple family groups. Friends or relatives such as siblings, or cousins, with their own children are considered separate family units and will require a separate booking and payment.
We understand that families can take many forms, and we’re open to discussing genuine special circumstances - including visiting family members or non-traditional caregiving arrangements. If this applies to you, please reach out before booking so we can work out what’s fair and workable for everyone.
Changes/Cancellations by Company
The Company reserves the right to cancel or reschedule a program at any time due to low enrollment, facilitator illness, natural disaster, or other circumstances beyond our control. In such cases, participants will be offered a full refund or transfer to a future offering.

Changes/Cancellations by Participant
Cancellations must be submitted in writing. Refunds or transfers are not guaranteed and are offered at the sole discretion of the Company. Where granted, they may be subject to an administration fee of 15% of the total program fee. No refunds will be given for non-attendance or withdrawal once a program has commenced.

Refunds
All refunds, where applicable, are processed minus any non-refundable deposits and third-party fees. Refund eligibility varies depending on the specific program and is at the sole discretion of the Company.

Airfares, Transfers, Passport, Visa, and Related Items
The Company is not responsible for any travel costs incurred by participants including but not limited to airfares, airport transfers, visa applications, or passport renewals.

Travel Insurance
Participants are strongly advised to take out comprehensive travel insurance to cover any unforeseen changes, cancellations, or emergencies related to participation.
​
Weather
Nature-based programs will go ahead in most weather conditions. However, safety is always the priority and changes may be made accordingly. Please dress and plan appropriately.

Photos, Video, Other Media Release
By attending, you consent to the respectful use of photographs, audio, or video recordings for promotional, educational, or archival purposes unless you explicitly opt out in writing before the program begins.

Voluntary Participation in Strenuous Activity
Some programs may include physical activities. Participation is voluntary and undertaken at your own risk. If you have any concerns, please consult your health professional prior to attending.

Health and Fitness Eligibility
You confirm you are physically and mentally fit to participate. It is your responsibility to disclose any relevant conditions at the time of booking.

Assumption of Risk
You acknowledge the inherent risks involved in participating in outdoor and group-based experiences and agree to assume full responsibility for any risk, injury, or loss. Please refer to the full Risk Warning and Waiver of Liability (below) for complete details and formal acknowledgement.

Injury, Waiver of Liability and Release
By participating, you release the Company and its facilitators from any liability for injury, loss, or damage, to the fullest extent permitted by law. The Company may require each adult participant to provide individual written or digital acknowledgement prior to attending any program, and reserves the right to deny participation if this has not been completed.

Binding Effect
These Terms and Conditions shall be binding upon you, your heirs, next of kin, executors, administrators, and assigns.
Changes in Terms
The Company may at any time and for any reason change, alter, remove or add terms to this agreement without a requirement for your consent. If any such terms are changed, altered, removed or added, the Company will notify and provide you with an updated copy of such terms. Any change, alteration, removal or addition of terms will not apply retrospectively, unless expressly stated. You are not eligible for any refund, discount or credit should such changes cause you any loss, damage or inconvenience.
B) Online and Blended Programs
Use of Content and Intellectual Property
All content provided through online programs—including written material, audio, video, resources, and platform access—is the intellectual property of Suzi Jayne and is provided for personal use only. You agree not to reproduce, duplicate, copy, sell, resell, share, or exploit any portion of the program or its content without express written permission from the Company.

Accuracy of Information
The information provided in online programs is for general education and information purposes only. While care is taken to ensure accuracy, the Company is not responsible for errors, omissions, or outdated content. Reliance on any materials is at your own risk.

Program Changes and Access
The Company reserves the right to change, update, modify, or discontinue any part of the online service at any time without notice. Access periods for programs may be time-limited and will be stated clearly at the time of purchase.

Pricing and Refund Policy
Prices for online programs are subject to change without notice. Unless otherwise stated, no refunds are available for online programs once access has been granted.

Participant Conduct
You agree to engage respectfully with facilitators and fellow participants. The Company reserves the right to remove access without refund in cases of breach of conduct or disrespectful behaviour.

Disclaimer and Limitation of Liability
Online services are provided "as is" and "as available." While we make every effort to deliver reliable and valuable content, we do not warrant that your use of the online services will be uninterrupted, secure, or error-free. Nor do we guarantee the accuracy, completeness, or reliability of any content. Your use of the service is at your sole risk.
To the fullest extent permitted by law, the Company and its affiliates, employees, contractors, and partners shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to access the service. This includes, but is not limited to, loss of data, loss of profits, or business interruption.

Indemnity
You agree to indemnify and hold harmless Suzi Jayne, its affiliates, staff, contractors, and facilitators from any claims, demands, losses, liabilities, and expenses (including legal fees) arising from your breach of these terms, your misuse of the service, or your violation of any law or third-party rights.

Termination
The Company reserves the right to terminate or suspend access to its online programs or services at any time, without prior notice, if you breach these Terms and Conditions or engage in any conduct deemed inappropriate or harmful. Any such termination shall not affect any accrued rights or obligations prior to the termination date. You may also terminate your participation at any time by ceasing to access the service. However, termination does not entitle you to a refund.
Severability
If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable for any reason, that provision shall be severed from the remaining terms, which will continue to be valid and enforceable to the fullest extent permitted by law.
Governing Law
These Terms and Conditions, and any separate agreements under which services are provided, shall be governed by and construed in accordance with the laws of Australia. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia, regardless of the participant’s country of residence.
2. Risk Warning & Waiver of Liability
The terms below form part of the booking agreement and affect your legal rights and obligations. Please ensure all adult participants included in your booking have read these terms carefully and fully understand the contents prior to making a booking. Registrations, bookings and waivers for participants under 18 years of age must be completed by a parent or legal guardian.

Programs offered by Suzi Jayne may include but are not limited to the following activities:

Bushcrafts

Bushland exploration
-
Bushwalks
-
Tree climbing
-
Use of ropes
-
Shelter building
-
Use of tools - including knives
-
Water exploration

Lighting and use of campfires
[1] Activities include all activities and services ancillary to or associated with the named Activity, both before and after the Activity, including transportation to and from the location of the Activity whether provided by the Provider or not, briefings, inductions, training, and the provision of information in all manuals, safety guidelines and other documentation provided to or made available to the Participant with respect to the Activity, familiarisation with clothing or equipment and methods of operation of equipment and the wearing and removal of any clothing or equipment associated with the Activity. Unless otherwise specified, a reference to an Activity is a reference to a recreational service or a recreational activity as defined in relevant legislation referred to herein.
Risk Warning:
I am aware that by my participation in any activities arranged by the Provider, certain risks or dangers may occur which could include:

Physical, bodily or psychological injury or death.

Physical exertion to which I am not accustomed.

Failure of equipment or use of inadequate equipment.
-
There may be no or inadequate facilities for treatment or transport to treatment if I am injured.

The conditions in which the activities are conducted may vary without warning.

I may cause injury to other persons and/or other persons may cause injury to me.
-
I may be injured or die due to the negligence, breach of contract or breach of statutory duty or guarantee of the provider.
I acknowledge that the activities are being undertaken for the purposes of recreation, enjoyment or leisure, and involve a significant degree of risk of physical harm.
I acknowledge that the Activity may be undertaken with one or more other persons as part of a group and that the Provider is not liable for the actions of other participants in the group activity.
By booking, I acknowledge, agree and understand that the risks associated with the Activities and/or recreational services have been explained to me. I undertake any such risk voluntarily and at my own risk.
I acknowledge that the risk warning above constitutes a “risk warning” in accordance with the Civil Liability Act 2002 (NSW) and the Civil Liability Act 2002 (WA).

Participant’s Warranties:
I agree to abide by any of the Provider’s rules, and any direction or instruction given to me by the Provider during the course of the Activities. I agree to use and/or wear any equipment given to me by the Provider.
I declare that I am medically and physically fit and able to participate in the Activities. I acknowledge that I must, and agree that I will, disclose any pre-existing medical or other condition, injury or concern that may affect the risk that either I or any other person will suffer injury, loss or damage during the course of the Activities and notify the Provider of any injuries, illness or concerns that may arise during the Activity. I will not engage in any reckless, negligent or foolish behaviour or any other behaviour that is likely to cause injury to me, any other participant or person.
I agree that if I suffer any injury or illness, the Provider may provide evacuation, first aid and/or medical treatment at my expense and that my acceptance of these terms and conditions constitutes my consent to such evacuation, first aid and/or medical treatment.
I declare that I will ensure that I have not consumed any alcohol or mind-altering substance, or medication that may impact my judgement or physical capacity, before or at the time of engaging in the Activities.

Exclusion of Liability:
I agree to and unconditionally release, waive, discharge and forever hold harmless, the Provider or any of its employees, agents, directors or officers, from any claims as a result of any personal injury sustained, whether caused by the Provider’s negligent act or wilful act or omission, breach of contract, breach of statutory duty, error, or otherwise in connection with or arising out of the Activities.
I agree that the Provider will not be liable for any claims for personal injury that may be brought against it as a result of or in connection with any act, omission, default, failure or error on the part of the Provider, and agree to indemnify and keep indemnified the Provider in respect of any such claims.
I agree that any Independent Owners of Land used by the Provider will not be liable for any claims for personal injury that may be brought against them as a result of or in connection with any act, omission, default, failure or error, and agree to indemnify and keep indemnified the Land Owner in respect of any such claims.

Waiver:
It is possible for a supplier of recreational services to ask you to agree that the statutory guarantees under the Australian Consumer Law (which is schedule 2 to the Competition and Consumer Act 2010 (Cth)) do not apply to you. By making a booking, you will be agreeing that your rights (or the rights of a person for whom or on whose behalf you are acquiring the services) to sue the Provider in relation to the Provider’s services or the activities that you undertake because the services or activities provided were not in accordance with the guarantees are excluded, restricted or modified as set out below.
For Queensland, New South Wales, Western Australia, Tasmania, Northern Territory and Australian Capital Territory and Commonwealth: By making a booking, you agree that the liability of the Provider in relation to the activities (as defined by the Competition and Consumer Act 2010 (Cth), the Consumer Affairs and Fair Trading Act (NT) and the Australian Consumer Law) and recreational activities (as defined by the Civil Liability Act 2002 (NSW) and the Civil Liability Act 2002 (WA)) for any: (a) Deaths; (b) Physical or mental injuries (including the aggravation, acceleration or recurrence of such an injury); (c) The contraction, aggravation or acceleration of a disease; (d) The coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to an individual: (i) That is or may be harmful or disadvantageous to you or the community; or (ii) That may result in harm or disadvantage to you or community; that may be suffered by you (or a person for whom or on whose behalf you are acquiring the services) resulting from the supply of the recreational services or recreational activities is excluded.
You acknowledge and agree that the above provision operates to exclude the liability of the Provider as a result of a breach of an express or implied warranty that the recreational services will be rendered with reasonable care and skill in accordance with section 5J of the Civil Liability Act 2002 (WA) and section 5N of the Civil Liability Act 2002 (NSW).

For Participant’s under age 18:
By making a booking as a parent/guardian with legal responsibility for the Participant, I acknowledge, understand and accept all of the above and consent to his/her release as provided above. I release and agree to indemnify and hold harmless the Provider from any and all liabilities arising from my minor child’s involvement or participation in the Activities and/or recreational services, even if arising from the negligence of the Provider.
Agreement to Terms & Conditions
By completing a booking or purchase of an online offering, you accept full responsibility for complying with these Terms and Conditions. Where bookings are made on behalf of other adult participants, you confirm that each has also read and agreed to these terms. The Company may request individual acknowledgment from each adult participant prior to attendance and may deny participation if this requirement is not met. This agreement forms a binding understanding between you (and all those included in the booking) and Suzi Jayne.
